Terms & Conditions of Argonauta Boracay Inc for Rooms Apartment Suites Villas
GENERAL Argonauta Boracay Inc acts as agent for the owners of the property, which you are booking.
All bookings are made subject to the acceptance of all persons named in the booking. ‘Us’ and ‘we’ refers to Argonauta Boracay Inc.
BOOKING RESERVATION, PAYMENT AND CONFIRMATION After receiving your inquiry for a room, apartment or villa we will confirm availability at the specified date and inform you about the rate per night. Should you make a reservation, the booking is CONFIRMED after 20% payment of the total amount due is deposited to our account. FULL PAYMENT is due upon check-in and a copy of your PASSPORT is required.
Payments can be made via bank transfer, in cash or through paypal.
INCIDENTALS A deposit in cash is required .
AMENDMENTS Amendment of your booking after confirmation may be subject to a charge if costs have accrued.
CANCELLATION Cancellations are acceptable in writing via email. In case of cancellation of your confirmed booking within 30 days prior to your arrival, no confirmation payment will be refunded. Cancellations earlier than 30 days may be refunded in the amount of 50% of the confirmation payment.
No liability can be accepted by us if you are forced to change or cancel your holiday due to force majeure reasons, which include, but are not limited to: war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, flood, adverse weather conditions, transportation or any other circumstances beyond our control.
USE OF THE RENTED PROPERTY
ALL ROOMS AND LOUNGES ARE NON SMOKING. Smoking inside the properties is subject to charge of Php 10,000. Henna tattoo stains in linen or towels are subject to charge. Bookings are considered to be for vacation purposes. The numbers of persons occupying a property must not exceed the number stated in the booking reservation. An extra charge applies for occupancy that exceeds the confirmed number of guests. Pets are not allowed.
Firearms, deadly weapons, illegal drugs as well as gambling are strictly prohibited. Some owners request the immediate repossession of their property in case male or female joiners are invited without being registered guests. In case of illegal or immoral activities, the offending guest will be summoned to the police and in case of repossession of the property total payment and security deposit is forfeit.
CONDUCT AND BEHAVIOR With these TERMS&CONDITIONS your and your parties agree to handle the interior and content of the rented property with utmost care while residing there. You agree to use all the content and facilities with due respect and mindfulness and in appropriate manner to avoid damages, breakages or excessive wear out. The behavior of you and your party is expected to be in a peaceful manner that does not affect the quiet enjoyment of neighboring properties and/or the safety of staff and neighbors. In case you or your party show no due care for the property or create excessive noise or nuisances that disturb the peaceful and quiet neighborhood and the adjoining properties, the owner or our representative may be forced to repossess the rented property and cancel your booking without reimbursement of total payment and/or ask the offending guest to leave the facility at their absolute discretion.
You and your party are responsible to take due care when using the rented property and the facilities, especially the walkways, staircases, pools and gardens, verandas and balconies as well as the rooms, bathrooms and kitchens to avoid accidents.
Damage or injury arising is not the liability of Argonauta Boracay Inc or the owners of the properties.
DETAILS OF RENTED PROPERTY All properties are equipped with in room safes for your valuables. Linen and towels are normally changed every three days. More frequent changes may have an extra charge. The kitchens are equipped with basic kitchenware, stove and refrigerator. Amenities are complimentary. Some properties offer free WIFI. Not included are transportation, gratuities, telephone, fax, food and beverage, laundry service, additional cleaning as requested or as necessary after your usage of the property as well as other goods or services requested by your or your party. Some properties may include staff or if you request staff, they may be hired if available. We are not liable for this hired staff, their performance or any effects their work may have on the property you are residing in.
SECURITY DEPOSIT A security deposit for rental of the villas or long-term rental of rooms and apartments may be required either in cash or by credit card guarantee. This security deposit is meant to cover the cost of any damage, breakages or loss of content that may appear at the rented property and its content during the rental period. This deposit will be returned to you at the time of your departure after the inspection of the rented property has shown no such damages, breakages or losses. In case the inspection shows damages that exceed normal wear and tear, the balance of the deposit will be reimbursed to your account after the repairs necessary to return the rented property to its original state, have been undertaken. In case the inspection shows loss of content of the property the value of the lost content will be deducted from the security deposit. Damages or Loss exceeding the security deposit are subject to additional charges to your account.
POOL, BEACH, SPORT, VEHICLES OR SERVICES It is our greatest concern to assure that you and your party may enjoy a safe and enjoyable holiday where leisure and recreation is not disturbed by any unforeseen events. Our facilities are maintained with utmost care and we are available to guide you and your party when choosing amongst the wide variety of services available for your entertainment and convenience. We cannot take liability for any of your or your parties’ vacation activities and we cannot guarantee that it is safe to engage in any of those services. It is at your or your parties’ own risk to: use the swimming pools, the public beach and normally calm ocean; water sport equipment like snorkeling or scuba diving gear; boats, paraws, bancas, jet skis, surf-, kite- or parasail equipment; bicycles, motorbikes, tricycles, ATV, hired vans or other modes of transport; to consume food and drinks offered by restaurants, kitchenettes or vendors; to engage services offered by sport schools, spas, massage or beauty parlors, gyms, health services or any other entertainment you may encounter while on your vacation.
LIABILITY We cannot accept responsibility for any discomfort, injury, sickness, loss, claim, damage, additional expense or inconvenience, directly or indirectly caused by or arising out of the use of the rented property and facilities (including exceptional weather conditions), or out of rendering service to you. In the event of equipment or facility failure we will endeavor to repair or replace the same with minimal disruption to you. We are unable to accept liability for the failure of equipment and facilities or the temporary non-availability of amenities described. Further, no responsibility is accepted for your personal belongings or of any other member of your party during the rental period within our premises or outside. Nor can we accept liability for circumstances that are due to your own actions, or to the actions of a third party, or to an unusual and unforeseeable circumstance whose consequences could not have been prevented by us. Furthermore, we are unable to accept responsibility for any aspect of your vacation affected by force majeure. We cannot be held liable for loss of main services such as electricity, water supply or internet connection, nor any actions taken in the vicinity of the villa by any person(s) or authority over which we have no control or influence. However, such eventualities may be covered by your travel insurance.
COMPLAINT We are unable to entertain verbal claims or claims submitted in writing by you or your party more than seven days after your departure or after you leave the property without a mutual agreement on how to solve a disputed matter.
INSURANCE We strongly recommend that you subscribe to a holiday insurance policy to protect yourself and your party in order to cover the cost of flight delays, cancellation by you, loss of baggage or other personal belongings, accidents occurring within the rented property, the facilities or through usage of third party services as motorbike or water craft rental, the cost of medical assistance including repatriation in the event of accident or illness or the cost of cancellation by us for reasons offorce majeure. We cannot accept liability should you find yourself not to be adequately insured for unforeseen events or circumstances in connection with our booking agreement.
ACCEPTANCE OF TERMS AND CONDITIONS TERMS&CONDITIONS may be amended if deemed necessary and we will duly inform you of those changes. In case the TERMS&CONDITIONS are not acceptable to you or your party, the booking reservation may be canceled without any cost involved.
LAW AND JURISDICTION Terms herein apply to the booking agreement. Philippine Law will govern any disputes and both parties shall submit to the jurisdiction of the Philippines (Pasig Courts) at all times. Where legal action is contemplated our authority must be obtained prior to commencement of proceedings. Our liability in respect of the above on behalf of you and your party shall not exceed the total cost of the amount paid for the property rental.
